Thank you so much for everyone for coming out tonight to the city council. We were really hoping they'd go ahead and vote the proposal down but the City Council decided to procedurally keep it alive and just did the second reading pushing off the final reading and vote until the next meeting. Let's keep it up! We need more signatures, ideas, emails to the city commission, etc... It's unfortunately not over and we still have to keep fighting. Despite turning in 75 of nearby neighbors signatures friday and having almost 150 before today's meeting, we apparently don't have enough yet to defeat it.
Put the next meeting on your schedule! September 19th at 7:00pm Reminder - meeting tonight at 7pm at City Council where they are trying to push this through! Be there! Share! Get your neighbors to come! We need as many bodies as possible.
Also, someone asked what happened 11 years ago on another post. Here was my reply to that: It was rejected because of the current house being in the right-of-way. It was shot down by the Fishers Town Council at that point very quickly because of that and didn't really even come to the fact that the neighbors didn't want it. This time, he seems to have the Fisher City fighting for him and as part of this they are adjusting the right-of-way and putting in there that the if the building were demolished the right-of-way would revert back to the city. Which means in the next ??? years when cumberland road is expanded to 2 lanes each way plus a center turn lane (it's on the Fishers 2030 plan but I would guess it will be done BEFORE the SR37 project to alleviate trafic during that project), the city will probably force it to be torn down and he'll have a case to request further zoning variance to remove the "restrictive" commercial zoning requirements being put into this request to "protect the neighbors" because the city is forcing his business to be demolished. Even if they don't rezone it for him at that point, a 25' office building with 10 parking spaces is the "extremely limited" commercial use he has "agreed to" put into the PUD (without ever consulting any neighbors or anyone outside the city staff). We have no idea how big a building that would be as, well, none of us know how to figure out that type of thing and questions asked of the City Staff get replied with "setbacks are such and such" and "maximum height of 25'". Scott Rhodes, a local resident and insurance agent, currently owns and operates the house along Cumberland at 13862 Cumberland Road and is requesting to rezone the property as Commercial so he can run his insurance company out of there. Our stance as the neighbors tot he property is that this should not be allowed and is not because of the insurance company it is the rezoning and the potential future possibilities on the plot.
At the Fishers Zoning Meeting on Tuesday, August 8th, the board voted to continue instead of approve the rezoning request due to some of the concerns that were raised. The current zoning proposal would allow a 30+ foot building to be built on the property if the house was demolished in the future and we are trying to get clarification from the town of Fishers how big that would really be. We will be circulating a petition to the nearby neighbors and trying to use this group to keep everyone informed of the progress of this action. 11 Years ago, his request for the same thing was denied at the property. He has just now sold his property in downtown Fishers where his business currently operates and is trying to rush this through the City so he can move in by September.
